Demerits and Fines

The demerit point system is designed to identify persistent traffic violators, and protect pedestrians and careful motorists from drivers who abuse the privilege of operating motor vehicles.

How It Works

The Registrar of Motor Vehicles will add demerit points to your driving record as the Registrar becomes aware of your offences. Demerits will be recorded on the driver’s record upon conviction of a driving related offence, and will remain on the driver’s record for 24 months. When you transfer in or out of any North American jurisdiction your driver’s record is transferred with you.

  • At 8 demerit points, the Registrar will notify the driver by registered mail of the points accumulated.
  • At 12 or more demerit points, the driver will be notified by registered mail of the number of points accumulated on his/her driver’s record. The registered letter will identify the steps necessary to arrange a telephone or personal interview with the Driver Examiner or a driver review officer. The driver must attend the interview as arranged. If he/she fails to attend the interview when required to do so, the driver’s licence will immediately be suspended until such time as the interview is held.
  • At 15 demerit points, the driver’s licence is suspended for a period of 30 days and will remain suspended until a re-instatement fee has been paid. The Registrar may demand surrender of the licence for the period of the suspension. At the conclusion of the suspension, the number of points on the driver’s record is reduced.

Reducing Demerit Points

Demerit points may be reduced once in a two-year period if a driver successfully completes an approved driver improvement course.

The driver improvement course will not affect the points remaining after serving a demerit point suspension.

If the driver reaches a level of 15 points a second time, the driver’s licence will be cancelled for a minimum period of 30 days to a maximum period of two years.

Appeal Process

A person may appeal the length of a suspension by submitting to the Department of Infrastructure a notice of appeal within 45 days after receiving the notice of suspension.
